The Court of Arbitration for Sport recently handed down a decision which was seen as a loss for promotion and relegation advocates, ruling that FIFA is not required to impose the system in the United States.

The ruling stems from a 2017 claim by Miami FC and Kingston Stockade, two lower division sides in the United States who petitioned the Panel to hold that Article 9, which covers “sporting merit,” and promotion and relegation, is a mandatory provision that FIFA is required to impose on its member associations.

Instead, CAS held that FIFA is granted wide discretion in how it applies their laws, and that when Article 9 was passed, it did not apply to countries that did not already have promotion and relegation in place.

The ruling itself is fascinating, featuring appearances from the likes of Sunil Gulati and Chuck Blazer of all people–seemingly from beyond the grave. Give it a read. I’ll have much more on this later.
